The Canada Spousal Open Work Permit (SOWP) is a category of Open Work Permit issued by IRCC to the spouse or common-law partner of an eligible foreign worker or international student in Canada. It lets the spouse work for almost any Canadian employer, without a job offer and without a Labour Market Impact Assessment (LMIA). The SOWP is split into two streams — one for spouses of skilled foreign workers in high-skill occupations, and one for spouses of international students in advanced programs. It is one of the most popular family-reunification work permits for Indian nationals whose partners are already in Canada on a work or study permit.
Total SOWP fees are CAD 255 — CAD 155 for the work permit plus a CAD 100 open work permit holder fee — with an additional CAD 85 for biometrics. On January 21, 2025, IRCC tightened both SOWP streams. The student-spouse stream is now restricted to spouses of master's students in programs 16 months or longer, doctoral students, and students in select professional programs (medicine, law, engineering, pharmacy, and a few others). The worker-spouse stream is now restricted to spouses of foreign workers in NOC TEER 0 or TEER 1 occupations, or in select TEER 2 or 3 occupations in priority sectors (natural and applied sciences, construction, healthcare, natural resources, education, sports, and military). IRCC also maintains special instructions for some public policy, PR-linked, and sector-specific cases, so applicants should verify the exact route before filing. The SOWP's validity typically matches the principal applicant's permit expiry, and holders can transition to permanent residence through Express Entry, the Canadian Experience Class, or a Provincial Nominee Program.
